Thank you for using Empoli!

 

These Terms of Use constitute a legal contract binding the Parties in all relationships between them, including but not limited to the use of the Platform and any other related websites and applications. By using our services, you agree to the following terms and conditions. Any violation will not be tolerated and will result in the immediate removal of access to our platform.

 

Definitions

 

a. Terms of Use - Contract between Lumina and the User of the products containing provisions for the use of the Platforms.

b. Lumina Lab - Technology Laboratory LTDA., located at Avenida das Américas, nº 1155, Sala 1908, Barra da Tijuca, Rio de Janeiro/RJ.

c. Platform - Online platform owned by Lumina Lab, accessible through the website app.empoli.ai.

​

d. User - Individual or legal entity registered on the Platform, who contracts the services offered by the Site.

1. Platform

 

1.1. The Platform has been developed to facilitate and provide its User with a unique and authentic experience. The Platform is considered a true digital concierge.

 

1.2. The services available through the Platform meet various User needs, such as services for:

1.2.1. Converts a Floor Plan into a Revit File The project employs artificial intelligence to transform input data from PDFs, images, or AutoCAD files into a structured document that can be opened in Revit. When an image or PDF is submitted, the converter produces a JSON file ready for Revit API reading. For AutoCAD files, the converter first transforms them into PDFs to train the model. Every time a client uses the converter, the data generated enhances the accuracy of our AI.

1.2.2. Generates a 3D Floor Plan in Revit via a Plugin Using the structured file from the converter, the plugin presents identified layers to the user, allowing them to verify and correct any errors, such as misidentified layers. These interactions provide feedback to the model, continuously improving its performance. Once validated, the plugin generates the 3D model.

1.2.3. Enables Virtual Reality Tours from the 3D Revit Floor Plan With the 3D file, the application facilitates virtual tours via VR glasses. Users can interact with the model, altering textures of finishes like floors, walls, doors, windows, and ceilings. The architect can oversee these changes and later implement them in the model to create the BIM (Building Information Model), personal trainer, tour guides, restaurant reservations, shows, and many others.

 

2. Registration and Use of the Platform Basic Terms

 

2.1. You are responsible for keeping your password secure.

 

2.2. You may not use Empoli’s service for any illegal or unauthorized purpose. International users agree to comply with all local laws regarding online conduct and acceptable content.

 

2.3. You are solely responsible for your conduct and for any data, text, information, screen names, graphics, photos, profiles, audio and video clips, links ("Content") that you submit, post, and display.

 

2.4. You must not modify, adapt, or hack Empoli or modify another website to falsely imply that it is associated with Empoli.

 

2.5. You must not access Empoli's private API by any means other than the Empoli website itself.

 

2.6. You must not scrape, crawl, or cache any content from Empoli.

 

2.7. You must not transmit any worms or viruses or any code of a destructive nature.

 

2.8. You must not violate any laws in your jurisdiction (including, but not limited to, copyright laws) while using Empoli.

 

2.9. Violating any of these agreements will result in the termination of your Empoli account. User

 

2.10. By registering on the Platform, you, the User, agree to pay all fees related to the hiring of the Site, including the price of the service to be provided and applicable fees.

 

2.11. Upon confirmation of your request on the Platform, a service contract ("reservation") is established directly between you and Lumina Lab.

 

2.12. For the proper provision of its services, Empoli needs to collect, store, transmit, and/or make available to third parties the data and information provided at the time of your registration.

 

2.13. The Site acknowledges that any use of your data by third parties, even if improper or causing you harm, will not imply any liability on the part of the Site, with any measures taken directly against the third party.

 

3. Prerequisites, Documentation, and User Responsibilities

 

3.1. The User is responsible for understanding and complying with all laws, regulations, and contracts, and declares that this Terms of Use is entered into for the free convenience of the Parties, in respect to the principle of free contracting.

 

3.2. The User is fully responsible for any acts performed while using the Platform that occur through their login and password. The User agrees not to provide their access credentials to anyone.

 

3.3. Verification of the use of the login by a third party will result in immediate termination and deletion of the User from the Platform’s database.

 

3.4. To validate and complete the Site’s registration on the Platform, the User must meet the requirements described below and provide the following documents on the Platform to prove their compliance: Identification document (Driver's License or ID with CPF number).

 

3.5. Under penalty of civil and criminal liability, the Site declares that all documents and registration information submitted to the Platform are authentic, current, and true.

 

3.6. It is emphasized that this Terms of Use is entered into for the free convenience of the Parties, in respect to the principle of free contracting.

 

3.9. The Site is fully responsible for any acts performed while using the Platform that occur through login and password.

 

3.10. Please note that the service contract will be signed exclusively between the Site and the User.

 

3.11. The Site assumes the obligation to fully support all direct or indirect damages, including, among others, convictions, costs, and expenses that may be attributed to the User of Empoli due to acts or omissions in the execution of the service. The obligation herein includes, but is not limited to, any administrative, judicial, and extrajudicial proceedings. In such cases, the Site authorizes the retention of proven damages.

 

4. Privacy Policy and Information Disclosure

 

4.1. Lumina Lab is committed to keeping you secure and maintaining the confidentiality of all registration data, including email, IP address, and any other personal information necessary for the provision of services.

 

4.2. Empoli and the User authorize Lumina Lab, at its discretion, to preserve and store all data and information sent to the Platform, as well as all personal data, such as email addresses, IP addresses, among other information, except under the conditions described in item 2.4 of this Terms of Use.

 

4.3. The use of the Platform implies the consent of the Site and the User for the collection, storage, and use of provided personal information and its updates, traffic data, IP addresses, among others.

 

5. Platform Fraud

 

5.1. Lumina Lab will not tolerate fraudulent conduct by the User under any circumstances and may temporarily or permanently prevent, suspend, or deactivate access to the Platform until the conclusion of an internal investigation, without any prior communication, as well as take legal or extrajudicial action against the person(s) involved in the fraud in question.

 

5.2. Lumina Lab will analyze suspicions of fraud on a case-by-case basis and may withhold payment of amounts due to Empoli as a result of fraudulent activities or even deduct from subsequent payments the amounts previously paid for which any type of fraud has been confirmed.

 

6. Suspension of Access or Deregistration from the Platform

 

6.1. Either Party may, at any time, request the termination of the relationship without cause by canceling the Empoli subscription, without the need for justification or prior notice.

 

6.2. Either Party may, at any time, request the termination of the relationship with reasonable notice by canceling the subscription.

 

6.3. Lumina Lab reserves the right to take legal and/or extrajudicial action in case of damages suffered by Empoli, instructing criminal, civil, and/or administrative proceedings in the cases provided by law and when deemed necessary.

 

7. Intellectual Property

 

7.1. Lumina Lab expressly declares that it holds all intellectual property rights related to the Platform and is in any case prohibited from providing services, ensuring that all content made available on the Platform does not violate any third-party intellectual property rights.

 

7.2. The Parties acknowledge that Lumina Lab is the sole and legitimate owner of the Platform and that all rights to its use are inherent to it, with this Terms of Use establishing the conditions for the User and other authorized persons' use of the Platform, with no transfer of rights regarding the ownership of the Platform and its contents.

 

7.3. The Platform is protected by all applicable laws, including copyright and intellectual property laws and international treaties.

 

7.4. Intellectual property rights related to Lumina Lab's business, including trade secrets, patents, patent applications, know-how, trademarks and service marks (registered or not), registered designs, design rights, copyrights, copyright databases, domain names, trade names, and any other similarly protected rights in any country (along with the right to apply for any of the above items, if applicable), as well as any modifications, updates, new versions, improvements, and derivative works ("Intellectual Property Rights") are and will remain the intellectual property of Lumina Lab. The User must not, in any way, copy, enhance, develop, or create derivative works, disclose or allow third parties access, lend, rent, sell, assign, transfer, or use the Intellectual Property Rights for any purpose, under penalty of violating copyright and industrial property rules, as provided for in Law No. 9.610/1998 and Law No. 9.279/1996, without prejudice to the penalties provided for violations of these Terms of Use. The obligation mentioned in this clause is total, definitive, irrevocable, and non-retractable, remaining in effect, therefore, after the termination of these Terms of Use for an indefinite period.

 

8. Data Protection

 

8.1. In compliance with the LGPD - General Data Protection Law - Law No. 13.709/18, the Parties commit to respecting each other's privacy, agreeing to protect and maintain the confidentiality of all personal data provided and possibly shared under these Terms of Use, except where they are required by authorities to disclose such information to third parties.

 

8.2. The Parties must comply with the requirements of technical and organizational security measures to ensure the confidentiality, pseudonymization, and encryption of personal data, including their storage and transmission.

 

8.3. Lumina Lab reserves the right to collect and store the personal data entered by Users solely for the purpose of ensuring the effective provision of services, compliance with legal and/or regulatory obligations, as well as for the purpose of preventing fraud, misuse of the Platform, and remediation of disagreements between the Parties.

 

8.4. The personal data of the Parties will not be shared with third parties under any circumstances, except within the strict limits of these Terms of Use and Empoli's policies for the effective provision of services.

 

8.5. The personal data will be stored by Lumina Lab, and Users are allowed to request the deletion of their data from the database whenever and wherever they deem necessary, provided that the deletion request will not be met when the stored personal data are necessary for the provision of services under these Terms of Use.

 

8.6. To request your account deletion, please send an email to geral@empoli.ai , geral@lumina.ai.

 

9. Final Considerations

 

9.1. Modifications to the Terms of Use will take effect on the date of their publication on the official website, and by continuing to use the Services provided through the Platform, the User automatically agrees to and is subject to the new Terms.

 

9.2. The Parties elect the Civil Court of the District of Rio de Janeiro to settle any disputes arising directly or indirectly from these Terms of Use, excluding any other, no matter how privileged it may be.

 

9.3. The Site may not transfer, assign, or encumber the rights and obligations arising from these Terms of Use without Lumina Lab's written consent.

 

9.4. The non-exercise of the right by either Party shall not be interpreted as a waiver of the same, and precedents may not be invoked as tacit novation.

 

9.5. This Terms of Use entered into between the Parties revokes any prior agreement, oral or written, having the same subject matter, that existed previously between the Parties.
